1. Who We Are
DOTPROX is operated by Burke Designs LLC. In these Terms, “DOTPROX,” “we,” “us,” and “our” refer to Burke Designs LLC and the services it operates under the DOTPROX brand, including the bible-embed hosted embeddings API.
2. Acceptance and Eligibility
You may use the service only if you can form a binding contract with us and your use complies with applicable law. If you use the service on behalf of a company or other entity, you represent that you have authority to bind that entity to these Terms.
3. The Service
The service includes our website, documentation, hosted embeddings API, model access, evaluation access, and any related support or enterprise discussions we choose to provide.
Unless we expressly agree otherwise in writing, the service is offered on an as-available basis. We may add, remove, limit, suspend, or modify features at any time.
Unless we expressly agree otherwise in writing, no service level agreement, uptime commitment, support commitment, or backward-compatibility obligation applies to the service. Evaluation, preview, beta, or pre-release features may be incomplete, change materially, or be discontinued at any time.
4. Accounts, API Keys, and Security
- You are responsible for activity under your account or API credentials.
- You must keep credentials confidential and notify us promptly of suspected unauthorized use.
- You may not share access in a way that circumvents pricing, seat limits, security controls, or intended service restrictions.
- We may suspend, rotate, or revoke credentials if we reasonably believe they are compromised or being misused.
5. Acceptable Use
You may not use the service to:
- Violate law or another party’s rights.
- Upload or process content you do not have the right to use.
- Interfere with the service, bypass rate limits, or probe for vulnerabilities.
- Reverse engineer, extract model weights, or attempt to reproduce the model beyond rights allowed by law.
- Use the service for spam, fraud, malware, credential abuse, or other harmful activity.
- Misrepresent benchmark results, origin, or provenance of service outputs.
- Use the service in connection with export-control, sanctions, or trade restrictions violations.
- Use the service in safety-critical, emergency-response, medical, legal, employment, insurance, credit, housing, or other high-risk decision contexts where errors could reasonably cause death, personal injury, or significant legal or financial harm, unless we expressly agree in writing.
6. Customer Content, Outputs, and Feedback
6.1 Your content
You retain whatever rights you hold in the text, data, and other content you submit to the service. You are responsible for making sure you have all rights, permissions, and lawful bases needed to submit that content.
If you submit content about other individuals or on behalf of end users, you are responsible for providing any required notices, obtaining any required consents, and establishing any required lawful basis for collection, processing, transfer, and use of that content.
6.2 Service outputs
As between you and DOTPROX, we do not claim ownership of the embedding vectors returned to you. You remain responsible for how you use outputs, including whether those outputs are appropriate for your application.
6.3 License to operate the service
You grant us a limited right to process submitted content solely to provide, secure, maintain, and support the service, as further described in our Privacy Policy and Data Policy.
6.4 Feedback
If you send us feedback, suggestions, or feature requests, we may use them without restriction or obligation to you.
7. Fees and Payment
Paid access, if offered, is subject to pricing, usage terms, or enterprise commercial terms we publish or provide to you. You are responsible for applicable taxes unless the law requires otherwise.
We may change pricing, usage measurements, packaging, credit policies, or payment terms prospectively at any time. Except as required by law or expressly agreed in writing, fees are non-refundable.
If you access bible-embed through a third-party platform such as OpenRouter, that platform may bill you separately under its own commercial terms.
8. Suspension and Termination
We reserve the right to suspend, restrict, or terminate access to the service at any time, for any reason, including misuse, violation of these Terms, legal or security risk, nonpayment, or use that could harm DOTPROX, our customers, or third parties.
You may stop using the service at any time. Sections that by their nature should survive termination will survive, including sections on ownership, disclaimers, limits of liability, and accrued payment obligations.
9. Third-Party Platforms and Services
If our model is accessed through a third-party marketplace, gateway, cloud provider, or integration platform, your use may also be governed by that platform’s terms, privacy policy, and retention rules. DOTPROX is not responsible for third-party services, billing, outages, or data practices outside our direct control.
You are responsible for reviewing and complying with any applicable third-party platform, provider, or marketplace terms that apply to your use of the service through those channels.
10. Export Controls and Sanctions
You may not use, export, re-export, transfer, or make the service available except as authorized by applicable export control, sanctions, and trade laws and regulations. You represent that you are not located in, not ordinarily resident in, and not controlled by any person or entity located in a restricted jurisdiction, and that you are not listed on any applicable government denied-party or restricted-party list.
11. Disclaimers
The service is provided “as is” and “as available.” To the maximum extent permitted by law, we disclaim warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, availability, and uninterrupted operation.
The service is not intended as a substitute for legal, medical, financial, or other professional advice, and you are responsible for validating its fitness for your use case.
12. Limitation of Liability
To the maximum extent permitted by law, DOTPROX will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, goodwill, data, or business interruption arising out of or related to the service.
To the maximum extent permitted by law, DOTPROX’s total liability for all claims relating to the service will not exceed the greater of (a) the amount you paid us for the service during the 1 month before the event giving rise to the claim, or (b) US$100.
13. Indemnity
You will defend, indemnify, and hold harmless DOTPROX, Burke Designs LLC, and their personnel from claims, losses, liabilities, and expenses arising out of your use of the service, your content, or your violation of these Terms or applicable law.
14. Governing Law and Dispute Resolution
These Terms and any dispute, claim, or controversy arising out of or relating to the service or these Terms are governed by the laws of the Commonwealth of Virginia and applicable United States federal law, without regard to conflict-of-law rules.
To the maximum extent permitted by law, any dispute, claim, or controversy arising out of or relating to the service or these Terms will be resolved by final, binding, individual arbitration. The arbitration will be administered in English under the then-current commercial arbitration rules of the American Arbitration Association by a single arbitrator. Unless we elect remote proceedings or the parties agree otherwise in writing, the arbitration seat and venue will be in Virginia.
Each party waives any right to a jury trial and any right to participate in a class action, collective action, coordinated proceeding, mass arbitration, or representative action. The arbitrator may not consolidate claims of different customers or preside over any class, collective, coordinated, or representative proceeding.
Nothing in this section prevents DOTPROX from seeking temporary, preliminary, or permanent injunctive or equitable relief, or from bringing claims relating to misuse, unauthorized access, nonpayment, confidentiality, intellectual property, or threatened harm, in any state or federal court located in Virginia. If this arbitration section is found unenforceable for any claim, then the parties agree that the exclusive jurisdiction and venue for that claim will be the state or federal courts located in Virginia, and each party consents to personal jurisdiction there.
15. Force Majeure
DOTPROX will not be liable for any delay, failure, or interruption caused by circumstances beyond our reasonable control, including infrastructure outages, denial-of-service attacks, labor disputes, natural disasters, war, terrorism, civil unrest, governmental action, internet or cloud failures, or failures of third-party providers.
16. Miscellaneous
We may assign or transfer these Terms, in whole or in part, including in connection with a merger, acquisition, reorganization, or sale of assets. You may not assign these Terms without our prior written consent. If any provision of these Terms is held unenforceable, the remaining provisions will remain in full force and effect. Our failure to enforce any provision is not a waiver. These Terms, together with any policies or terms expressly incorporated by reference and any separate written agreement between you and DOTPROX, form the entire agreement regarding the service.
17. Changes to These Terms
We may update these Terms from time to time. If we make changes, we will post the updated version here and update the “Last updated” date above. Your continued use of the service after the updated Terms become effective means you accept the revised Terms.
